These terms apply when you use twigacoffee.com or buy from us. Please read them. By using the site or placing an order, you agree to them.
Twiga Coffee is operated by Greedy Bites, Inc. dba Twiga Coffee, a California corporation.
Using our site
You may browse, shop and use our site. You agree not to misuse it, which includes not attempting to interfere with the site or its security, not using automated tools to scrape or overload it, and not using the site for anything unlawful.
If you would like to stock Twiga Coffee, or buy from us to resell, we would genuinely like to hear from you. Email info@twigacoffee.com or see our Wholesale page, so that we can set you up properly and make sure our coffee reaches your customers fresh.
Who can order
You must be able to enter into a binding contract in your state to place an order, and you must provide accurate information at checkout.
Our products
We sell roasted coffee, matcha, related drinkware and accessories, apparel, and gift cards, and we offer coffee subscriptions.
Coffee is an agricultural product. Harvests vary, and a coffee you have enjoyed before can taste different from one lot to the next. We describe every coffee as accurately as we can.
Product information
We work hard to describe our products accurately, including origins, certifications, tasting notes and weights. Even so, descriptions, images and other content may occasionally contain errors. Colours can also look different on different screens.
If a product is not as described, tell us and our Refund and Return Policy applies.
Availability
Our coffees are produced in limited lots and can sell out or change. We may add, change or discontinue products at any time without notice.
Orders
When you place an order you are making an offer to buy. The confirmation email we send tells you that we have received your order. It is not yet our acceptance of it. We accept your order when we ship it, and that is when the contract between us is made.
Between receiving your order and shipping it, we may decline or cancel it if:
- The product is unavailable
- There was a pricing or description error
- We cannot verify the billing or shipping information
- We suspect fraud or unauthorised use of a payment method
If we cannot fulfil an order you have already paid for, for any of these reasons or any other, we refund you in full.
Pricing
Prices are in U.S. dollars and can change at any time. The price that applies to your order is the price shown at checkout when you place it. Sales tax is calculated at checkout where it applies. If a product is listed at an obviously incorrect price, we may cancel the order and refund you rather than fulfil it.
Payment
We accept the payment methods shown at checkout. By providing a payment method you confirm you are authorised to use it. Payments are handled by our payment providers and are subject to their terms.
Shipping
Shipping is covered by our Shipping Policy, which forms part of these terms. We ship within the United States only.
Returns and refunds
Returns and refunds are covered by our Refund and Return Policy, which forms part of these terms.
Subscriptions
Subscriptions are covered by our Subscription and Cancellation Policy, which forms part of these terms. In short: subscriptions renew automatically until you cancel, and you can cancel at any time with no fee.
Gift cards and promotions
Twiga Coffee gift cards do not expire and carry no fees. Gift card terms are set out in our Refund and Return Policy.
Discount codes and promotions may have their own conditions, such as an expiry date, a minimum order, or limits on which products they apply to. Unless we say otherwise, one code applies per order, and codes have no cash value and cannot be applied to past orders.
Reviews and other content you post
If you post a review or send us photographs, comments or suggestions, you keep ownership of what you wrote, and you give us permission to use, display and share it in connection with Twiga Coffee. Please only post content that is yours to share, that is honest, and that is not offensive or unlawful. We may remove content that is not.
Our brand and content
The Twiga Coffee name, our giraffe mark, our logos, our photographs and our written content belong to us and are protected by trademark and copyright law. Please do not use them without our written permission.
Third party services and links
Our site uses third party services and may link to other websites. We do not control them and are not responsible for their content or their privacy practices.
Disclaimers
We provide our site and our products with care, but we provide the site itself on an "as is" basis and do not promise it will always be available or error free.
Nothing in these terms limits any warranty or right you have under law that cannot be limited. Some states do not allow certain disclaimers or limitations, so parts of this section may not apply to you.
Food safety and allergens
Our products are food. Please read the product page and the packaging for ingredients, allergen information and storage guidance. Coffee and matcha contain caffeine.
Limitation of liability
To the extent the law allows, Twiga Coffee is not liable for indirect, incidental or consequential losses arising from your use of the site or our products, and our total liability for any claim relating to an order is limited to the amount you paid for that order.
This does not limit liability that cannot be limited by law, including liability for death or personal injury caused by our negligence, or for fraud.
Indemnity
If you misuse the site or break these terms and that causes a third party claim against us, you agree to cover the reasonable costs we incur as a result.
If part of these terms does not apply
If any part of these terms is found to be unenforceable, the rest still applies.
Governing law
These terms are governed by the laws of the State of California, without regard to its conflict of laws rules.
Changes
We may update these terms. The current version is always on this page, with the date it was last updated. Changes apply to orders placed after they are posted.
